The inventory of fixtures is an essential complement to the lease. Often neglected by the owner or tenant, its omission or vagueness are the source of many rental conflicts , when at the end of lease the tenant claims his deposit.

In the order to avoid disputes with your landlord or tenant, it is important to understand the concept of the state of play and what it entails. 

What is the inventory of fixtures ?

The inventory of fixtures is a document that describes the accomodation and its equipment on a piece by piece basis when the tenant enters the house (inventory of entry) and at the time of departure (inventory of places of exit).

 

Who makes the inventory and when ?

The inventory of fixtures is established by the owner, in the presence of tenant.

If one of the parties is absent, a bailiff may be called upon to prepare it. The owner may be represented by the manager of his building or by the real estate agent who contributed to the rental of the apartment to carry out the inventory. However, this must be clearly stated in the document.

The inventory is made at the time of the handing-over of the keys to the tenant, before he even ocupies the house.

How to establish an inventory of fixtures ?

The inventory of fixtures is written during and after the inspection of the housing , its equipments and its dependencies. It must be clear and detailed.

Do not limit yourself to the use of general terms such as " dwelling in good condition", "good condition in general",  but prefer precise terms like "broken tile on bathroom tile", "peeling paint", "mold on the walls", "plumbing in good working order" etc.

If it is a furnished dwelling, do not hesitate to check the operation of the electrical appliances and the condition of the furniture.

When the inventory of fixtures has been achieved under certain conditions such as a power outage, it must  also be mentioned .

Why make the inventory of fixtures ?

The main reason for the inventory is that is allows to determine at the end of the lease, which of the owner or the tenant is in charge to carry out the necessary repairs to the restoration of good condition of the housing.

It is proof that you have received the property as it is at the time of your departure and thus prevents you from losing a portion of your security deposit that would have been used to pay the repaid costs.

It therefore saves you money and time because that says repairs, say spending !

What happens in the absence of the inventory of fixtures ?

Several reasons can justify the absence of an inventory of the situation in particular :

  • The refusal of the owner : If the owner refuses to draw up the inventory , it is recommended by a bailiff. The bailiff's report will enable you to prove your good faith if the case comes to court. If this solution seems a bit risky, you can have an act written by the owner in which he must specify that he refuses to proceed with the inventory and that will be signed by him and you. This act  will serve as a means of proof in case of conflict with the owner.
  • The tenant's opposition :  If the tenant objects to the establishment of an inventory when he enters the dwelling, he is deemed to have received it in good condition. He can not refuse at the end of the lease, to carry out the repairs indicated by the owner. 
  • The negligence of the parties : If the owner and the tenant neglect to draw up an inventory at the beginning of the lease, the tenant is supposed to have received the house in good condition.

 

From all that has been said, it is found that it is advantageous for the tenant to proceed to the establishment of a state of the premises when he enters the dwelling before he even inhabits it.

This document avoids him at the end of the lease, to make repairs for the degradations that he did  not cause but especially to stay on good terms with his former landlord.
